K4G VIP Terms & Conditions

1. Definitions

  1. 1.1In this document the following terms shall have the following meaning:
    • a)“Regulations” – this document;
    • b)“T&C” – K4G  Terms and Conditions of the Website;
    • c)“User” or “you” – any person who has registered an Account on the Website according to provisions of T&C, and subscribes to the K4G VIP program;
    • d)“K4G VIP” – program available on the Website, which consist in the use or the possibility to use the Benefits specified in the Regulations by the User;
    • e)“Website” – website, available at https://k4g.com/  with all of its subdomains;
    • f)“Benefits” – additional services or bonuses to which the User is entitled to as a result in participation in K4G VIP;
    • g)“Billing Period” – settlement period of 1 (one) month. For the purposes of the K4G VIP, a period of one month means 30 calendar days;
  2. 1.2Singular expressions also apply to the plural when the context so requires, and vice versa.

2. General provisions

  1. 2.1These Regulations contain rules of membership in K4G VIP program, This document is therefore a legally binding contract between you (User) and us (Service Provider) from the moment you subscribe to K4G VIP.
  2. 2.2In matters not covered by these Regulations, the provisions of T&C shall apply. Capitalized words not otherwise defined in these Regulations, have the meaning given to them in the T&C. In the event of a discrepancies between the content of these Regulations and the content of the T&C, the provisions of these Regulations shall prevail.

3. Subscription. Fees.

  1. 3.1Participation (membership) in K4G VIP is payable. The User who wishes to participate in K4G VIP should subscribe to it by using appropriate tab on the Website and choose payment method as well as the Billing Period and pay the membership fee for first Billing Period.
  2. 3.2The fees for subscription to K4G VIP (membership fees) are as follows:
    • a)1.99 EUR + VAT and operational fee - in case of 1 month Billing Period;
    • b)2.99 EUR + VAT and operational fee - in case of monthly renewal;
  3. 3.3Fee for the first Billing Period is charged in advance, upon the moment you subscribe to K4G VIP. Your membership in K4G VIP is activated when we receive payment for first Billing Period (payment status "Completed").
  4. 3.4Your subscription is automatically extended (renewed) for subsequent periods according to your choice of Billing Period (e.g. if you chose one month Billing Period your subscription is automatically extended for a period of one month), provided that the User pays the fee for the next Billing Period (renewal fee). When you subscribe to K4G VIP, you authorize us to automatically charge you with the renewal fee.
  5. 3.5The amount of renewal fees correspond to the amount of membership fees, specified above. The renewal fees are also charged in advance (on the first day of the given renewal period). You will be charged with renewal fees on the same day of a month in which you subscribed for the first time. However, if your billing day is scheduled for a day that does not occur in every month (for example, the 31st), you will be charged with renewal fee on the last day of that month instead.
  6. 3.6The subscription is automatically extended until the User unsubscribes or the subscription is terminated by the Service Provider.
  7. 3.7We reserve the right to change the amount of membership fees and renewal fees. The change will not affect the payments made by the User prior to the change. We will notify you about any changes of the fees by e-mail. We will also publish the Regulations with new amounts of fees on the Website. Change of the fees will come into force within 7 days from the e-mail notification. Any change of the renewal fees shall be effective starting from the next Billing Period, provided that we kept 7-day gap between the notification and the start of your next Billing Period. If you do not agree to new fees, you should unsubscribe from the K4G VIP according to the provisions of §6 of these Regulations.
  8. 3.8Subject to point 3.11. below, membership fees and renewal fees are non-refundable. The Service Provider does not refund payments if User unsubscribes before the end of given Billing Period or if the User has not used all the Benefits.
  9. 3.9Upon subscribing and renewal of subscription, you will also be charged with VAT and service fee. Service fee depends on the method of payment chosen by the User and will be visible in checkout before subscribing for the first time. If you decide to change the payment method prior to renewal of subscription, service fee we charge you may change.
  10. 3.10Fees for subscription and for renewal are made in EUR. If you make payment of the fees in currency other than EUR, you may be charged by your bank or payment operator with additional currency exchange fees independent of us.
  11. 3.11The User from European Union (who is a consumer) has the right to withdraw from the subscription to K4G VIP within 14 (fourteen) days without giving any reason. The period of 14 days is counted from activation of your membership in K4G VIP. In order to use the withdrawal right you need to give us an unequivocal statement which may be filed by e-mail (to the address: [email protected]) or through the support systems available on the Website. If the User withdraws from this subscription, the Service Provider will reimburse to him/her all payments received from the User, no later than within 14 days from receipt of the withdrawal statement.

4. Benefits

  1. 4.1Within K4G VIP membership, the User is entitled to the following Benefits:
    • a)Promotional code for monthly, weekly or daily discounts – as a member of K4G VIP program, you will receive unique promotional code which may be use for the purchase of the Products included in monthly, weekly or daily discounts (these codes will affect ONLY Products that are marked on the Website in the monthly, weekly or daily discounts). You may use the code to receive a discount for the purchase of such Product. The promotional code applies only to the purchase of the Product with a purchase price to 50 EUR.
      • i.The use of a promotional code will reduce the purchase price of the Product by:
        • 16% - for Products from a monthly discount;
        • 18% - for Products from a weekly discount;
        • 20% - for Products from a daily discount;
      • ii.A promotional code can be used (during the given Billing Period):
        • 2 times - in case of using the code for purchase of the product covered by the monthly discount;
        • 1 time - in case of using the code for purchase of the product covered by the weekly discount;
        • 1 time - in case of using the code for purchase of the product covered by the daily discount;
    • b)Free of charge access to KPP – if you are K4G VIP member, your purchase of the Product covered during given Billing Period by monthly, weekly or daily discounts will always be covered by K4G Purchase Protection (KPP).
    • c)Discount Alert – as a member of K4G VIP program, you will receive additional newsletter (by e-mail) containing information on the latest discounts under the K4G VIP program.
    • d)Give-aways – as a member of K4G VIP program, you will have access to weekly or monthly give-aways, on a separate page on the Website (not accessible for the users who are not K4G VIP members).
    • e)Pre-order priority – your pre-orders will always be put first in line and sent to you before other users (users of the Website who are not K4G VIP members), even if they bought the pre-ordered Product sooner than you.
    • f)LiveChat priority – if you are K4G VIP member, your inquiries submitted in LiveChat available on the Website will always be put first in line (prior to the users of the Website who are not K4G VIP members).
  2. 4.2The User may not sell the Benefits to any third parties or share for free the Benefits with third parties (including other users of the Website). In particular, the User is not entitled to share the promotional code with Website’s users who have not subscribed to the K4G VIP.

5. Liability

  1. 5.1The User is not entitled to demand from the Service Provider the equivalent of the Benefits in money.
  2. 5.2The User is not entitled to demand financial compensation in exchange for the Benefits that the User did not use in given Billing Period.
  3. 5.3Unless otherwise provided by generally applicable law, the Service Provider's liability to the User under the K4G VIP program shall be limited to an amount equal to the sum of the fees actually paid by the User for the subscription.

6. Termination

  1. 6.1The contract for your membership in K4G VIP is concluded for an indefinite period.
  2. 6.2The User may unsubscribe from K4G VIP (terminate the contract for your membership in K4G VIP) at any moment. Unsubscribing will be effective at the end of the Billing Period in which the User unsubscribed. In order to unsubscribe, the User should use a proper tab in the Website (in the User’s Account).
  3. 6.3If you fail to pay the renewal fee (including the situation when the renewal fee cannot be automatically collected from your payment card or other payment method you chose), we will suspend your membership in K4G VIP. It will mean that you will no longer have access to the Benefits.
  4. 6.4We may unsubscribe your membership in K4G VIP (terminate the contract for membership in K4G VIP) if your delay in payment of renewal fee is at least 15 (fifteen) days. Unsubscribing will be effective at the end of the Billing Period in which the User was unsubscribed.
  5. 6.5We may unsubscribe your membership in K4G VIP with immediate effect for important reasons, in particular but without limitation if you committed the material breach of these Regulations or if we deleted your Account with immediate effect under the provisions of the T&C.

7. Final provisions

  1. 7.1These Regulations shall be governed by and construed in accordance with the laws of Cyprus. The above choice of applicable laws does not exclude nor limit your rights arising from generally applicable laws in your country of residence if you are a Consumer.
  2. 7.2We aim to resolve any dispute between us and Users amicably. If you have any queries to us, you can contact us via:
    • a)contact details provided in the T&C;
    • b)contact forms and support systems available on the Website.
  3. 7.3However, if we fail to reach an amicable solution to the dispute, the disputes will be settled by the courts having jurisdiction over our registered seats. The above does not limit your right to start legal proceedings in your country of residence (if you have such a right under the generally applicable laws in your country of residence, in particular if you are a consumer). If you are EU consumer, you have the right to use out-of-court methods of settling disputes arising from contract concluded with us, in particular you have the right to use Online Dispute Resolution platform operated by the European Commission (details on this can be found on this website: http://ec.europa.eu/consumers/odr/).
  4. 7.4We reserve the right to change these Regulations at any time. We will notify you about any changes to the Regulations via e-mail. We will also publish the amended content of the Regulations on the Website. Changes to the Regulations will come into force within 7 days from the e-mail notification (unless we provide longer term). If you continue to participate in K4G VIP after the entry into force of the amended Regulations, we will assume that you agree to the changes. If you do not agree to the changes, you should unsubscribe from K4G VIP.
  5. 7.5The above provisions does not apply to the change of fees for subscription, which are subject of §3 of the Regulations.
  6. 7.6These Regulations are available on the Website free of charge in a manner enabling its recording.
  7. 7.7These Regulations may be also available in languages other than English. However, in case of any discrepancies between the language versions, the English version shall prevail.
  8. 7.8If any provision of these Regulations should be found invalid or ineffective, such provision shall be omitted, which does not affect the validity of the remaining provisions of the Regulations.
  9. 7.9The rules on personal data processing of the participants of K4G VIP are included in K4G Privacy Policy.
